Part 1: OFCCP Audit Issues Learn the tools to prepare for a successful audit by the OFCCP. Ensure your AAPs comply with the Executive Order 11246 requirements, including the new LGBT regulations, as well as the new data collection and analyses required by the regulations for individuals with a disability under Section 503 of the Rehabilitation Act and for protected veterans under the Vietnam Era Veterans’ Readjustment Assistance Act. Part 2: AAP Basics One of the best ways to prepare for a successful audit by the OFCCP is to prepare good AAPs each year. Learn how to collect the data required by the federal regulations and how to select the best options for presenting that data in the final AAPs. Avoid the most common recordkeeping pitfalls by ensuring you are properly identifying applicants and offering the voluntary self-identification opportunities at the appropriate times, using the appropriate forms. Discuss how the new compliance requirements can best be implemented in your workforce and how to communicate most effectively the burdens imposed by the regulations to ensure you have buy-in from your executive team and stakeholders. Part 3: OFCCP Construction Contractors AAP’s  Learn how the new Section 503 regulations for individuals with a disability, as well as the new veterans regulations, affect construction contractors. Review the mandatory steps required in the construction contractor AAPs and discuss some of the key focus areas the OFCCP has been pursuing in their construction contractor audits.

Part 4: OFCCP Updates In the last few months, OFCCP has issued a plethora of new regulations, as well as Executive Orders, Directives, and other internal guidance. We will review the revised Compensation analysis under Directive 308, the data collection and analysis requirements for applicants and the workforce imposed by Section 503 for individuals with a disability and by VEVRAA for protected veterans, the new federal minimum wage, the new Equal Pay report, the Fair Pay and Safe Workplaces Executive Order that requires employers to self-report any adverse findings, the new VETS-4212 reporting requirements, the new sex discrimination guidelines, and the LGBT regulations adding “sexual orientation” and “gender identity” as protected categories.
